Terms of Use

Welcome to SpotLite. These Terms of Use (the "Terms") constitute a legally binding contract between you and PEREZ LAVADIE JAVIER ("SpotLite", "we"). By creating an account or using our services, you accept these Terms as well as our Privacy Policy and our Community Guidelines. If you do not agree, do not use the platform.

1. Eligibility and account#

You must be at least 16 years old and have the legal capacity to contract. You undertake to provide accurate information and keep it up to date, to keep your credentials confidential and to report any unauthorized access to us. You are responsible for all activity carried out from your account. An account is personal; its transfer or sharing is prohibited.

2. Host role and user content#

SpotLite acts as a host within the meaning of the French LCEN law for content published by users (videos, audio, company reviews, profiles). We do not exercise systematic prior editorial control, but we provide reporting tools and moderation (human and automated) described in our Moderation Charter. You remain solely responsible for the content you publish and warrant that you hold all rights to it.

3. The license you grant us#

You remain the owner of your content and your data. In order to operate and provide our services, you grant us a worldwide, non-exclusive, transferable, sublicensable and royalty-free license, for the legal duration of protection, allowing us to host, store, reproduce, adapt, translate, index, publish, display and process your content as part of operating and promoting the platform. This license notably allows us to:

  • Generate AI-derived content: analyze your CVs, videos and documents to produce semantic profiles, job matches and recommendations.
  • Train our proprietary AI models: use your published content (in raw, transformed or anonymized form) to develop, evaluate and improve our models, under the conditions and with the objection rights provided for in our Privacy Policy and our AI & Data Charter. Data from your Google/Apple accounts is excluded from this training.
  • Enable B2B sourcing: if you enable it in your Cockpit, allow our certified partner companies to search, view and extract your unified skills and your certified diploma proofs via our professional APIs.

You can revoke this license for the future by disabling the relevant options or deleting your account; this revocation affects neither content already distributed, nor models already trained, nor licenses already granted to third parties in good faith.

4. Prohibited uses#

You undertake not to: publish illegal, hateful, violent, sexually explicit, defamatory or misleading content; impersonate an identity or create fake profiles; submit falsified documents; harass or harm others; collect or extract data from other users without authorization (scraping); circumvent our security, App Check or anti-abuse measures; disrupt the service; or use the platform for fraudulent purposes. Failure to comply with these rules may lead to the sanctions provided for in article 8.

5. Paid services, credits and AI#

Access to certain features (subscriptions, passes, credits, AI services) is paid and governed by our Payment, Credits and Refund Policy, which you accept when making a purchase. Credits are an internal virtual currency, not convertible into real money.

6. AI liability (accuracy and hallucinations)#

SpotLite uses AI models to help you write CVs and assess the consistency of documents. These technologies may produce inaccuracies or "hallucinations". It is your responsibility to review, verify and validate each piece of information before any use, particularly before sending it to an employer. SpotLite disclaims all liability for any erroneous statement, inaccuracy or exclusion from a recruitment process linked to content generated by the platform.

7. Limitation of liability and availability#

The service is provided "as is" and "as available". To the extent permitted by law, SpotLite is not liable for indirect damages, loss of data, revenue or opportunity, nor for third-party content. Nothing herein limits our liability in the event of gross negligence, willful misconduct, personal injury or where the law prohibits it, in particular with regard to consumers. We strive to ensure continuity of service but do not guarantee uninterrupted availability.

8. Suspension, termination and device blocking#

You can close your account at any time. We may suspend or terminate your account, and block your device's access (device identifier ban), in the event of a serious breach of these Terms, fraud, document fraud or risk to the platform or its users. Except in an emergency or legal obligation, we inform you of the measure and its reasons, and you can contest it with our support team (see Moderation Charter).

9. Amendment of the Terms#

We may amend these Terms. Significant changes are notified in the app with a new version and, where applicable, a request for re-acceptance. Continued use after the effective date constitutes acceptance.

10. Governing law and disputes#

These Terms are governed by French law. Failing an amicable resolution (and after possible recourse to the consumer mediator indicated in our Legal Notice), any dispute falls under the competent courts, subject to the protective rules applicable to consumers.
